Terms of service

1. Agreement

These Terms of Service govern your use of hayalegacy.com and purchases from HAYA Legacy, a brand operated by Haya Trading Inc. By using the store or placing an order, you agree to these Terms and the policies linked from the store. If you do not agree, do not use the store.

2. Eligibility and accurate information

You must have legal capacity to enter into a purchase agreement. You agree to provide accurate, current and complete information and to update it when necessary. You are responsible for activity under your customer account, if accounts are enabled.

3. Products and descriptions

We aim to provide fair and accurate product descriptions, measurements, colours and images. Screen settings and lighting may cause minor colour differences. Measurements are approximate. These limitations do not permit materially inaccurate descriptions or images. Product availability and assortment may change without notice.

4. Prices, currency and taxes

Prices are shown in Canadian dollars unless the store states otherwise. Applicable taxes and shipping charges are displayed during checkout. We do not intend to add undisclosed mandatory fees to an advertised price. A genuine pricing or configuration error may be corrected before fulfilment; if an affected paid order is cancelled, the applicable amount will be refunded.

5. Orders and acceptance

An order confirmation acknowledges that we received the order. It does not necessarily mean the order has been accepted. We may reasonably reject, limit or cancel an order before fulfilment because of inventory errors, payment failure, suspected fraud, pricing errors, shipping restrictions or other legitimate operational reasons. If a paid order is cancelled, the applicable amount will be refunded.

6. Payments

Payment is processed through Shopify and the payment methods enabled at checkout. You authorize the applicable charge and represent that you are permitted to use the selected payment method. Payment providers may apply their own terms and privacy policies.

7. Promotions and discount codes

Promotions are subject to their stated dates, eligibility, product exclusions, minimum spend and combination rules. A discount has no cash value. We may refuse misuse, fraud or a technical exploitation of a promotion. This does not allow us to retroactively change an accepted order without an appropriate remedy.

8. Shipping, delivery, returns and refunds

Shipping and delivery are governed by the Shipping & Delivery Policy. Returns, exchanges and refunds are governed by the Returns & Exchanges Policy. Those policies form part of these Terms.

9. Customer accounts

When customer accounts are available, you are responsible for protecting your credentials and notifying us of suspected unauthorized access. We may suspend an account where reasonably necessary for security, fraud prevention or a material breach of these Terms.

10. Reviews and submitted content

When you submit a review, photograph, message or other content, you confirm that you have the right to provide it and that it is not unlawful, misleading, infringing, abusive or deceptive. You grant Haya Trading Inc. a non-exclusive, worldwide, royalty-free licence to use, reproduce and display the submitted content for store operations and marketing, subject to applicable privacy law and any permissions requested for identifiable photographs. We may moderate content but should not alter a review in a way that changes its meaning.

11. Acceptable use

You must not misuse the store, interfere with security, access non-public systems, introduce malware, scrape the store in a harmful manner, commit fraud, infringe intellectual property, impersonate another person or use the store for unlawful activity.

12. Intellectual property

The HAYA Legacy name, logos, store design, text, graphics, product photography and other content are owned by or licensed to Haya Trading Inc. and are protected by applicable law. No content may be copied, republished or commercially used without permission except as permitted by law.

13. Third-party services and links

The store relies on third-party services, including Shopify, payment providers, carriers and apps. We are not responsible for a third party's independent services, websites or policies, but we remain responsible for obligations that applicable law places on us.

14. Availability and changes

We may maintain, update, suspend or change store features. We do not guarantee uninterrupted availability. 

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without limiting mandatory rights that apply to a customer in another province or territory.

16. Severability and waiver

If a provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a provision is not a waiver.

17. Changes to the Terms

We may update these Terms for future use of the store. The updated version will show its effective date. Changes will not retroactively remove rights attached to an order already accepted unless permitted by law and appropriately communicated.
